The following Statement sets out the Privacy Policy of V.H.L. Developments Inc. and its affiliated and associated companies using the “VHL Developments” tradename in its corporate name (herein collectively referred to as “VHL”).

For the purposes of this Statement, "personal information" means information that is personally identifiable to individuals. "Non-identifiable information" means information that cannot be associated with or traced back to specific individuals with any certainty.

1. THE COLLECTION OF PERSONAL INFORMATION BY VHL

VHL will collect personal information from individuals on a voluntary basis by means of surveys, registration forms, questionnaires and Agreements of Purchase and Sale and related documentation, both online and in paper writing. The personal information includes contact information (for example, name, mailing address, e-mail address, telephone number), demographic information, household information, preference information, transaction-related information and information that VHL is required to collect from purchasers pursuant to the federal anti-money laundering legislation (such as, for example, banking, occupation, driver’s license, social insurance number information).

2. USE OF PERSONAL INFORMATION

Personal information will be collected in order to communicate with individuals, understand needs and develop products and services, promote and offer products, services and special offers and provide ongoing service to purchasers. As well, the information will be used to complete transactions with purchasers from VHL.

VHL, and/or its consultants, solicitors, agents and the like may, from time to time, contact individuals by email, fax, regular mail or telephone for any of these purposes.

3. DISCLOSURE OF PERSONAL INFORMATION

VHL will disclose personal information to third parties only in the following circumstances:

(i) When the individual’s consent to do so is obtained at such time as personal information is collected;

(ii) When VHL does so believing, in good faith, that the law permits or requires the disclosure;

(iii) Amongst companies using the “VHL Developments” tradename in its corporate name, including those to be incorporated in the future, for the purposes set out herein;

(iv) To its solicitors, professionals consultants, contractors and the like for the purpose of completing Agreements of Purchase and Sale and related transactions, to process information and to provide service to purchasers.

4. NON-INDENTIFIABLE INFORMATION

VHL will collect and use non-identifiable information to assess the effectiveness of web site content and traffic so that VHL may enhance the web browsing experience of its customers and, as well, to perform statistical analyses of behaviour of individuals and measure demographics and interests.

Non-identifiable information may be used to provide information pertaining to its products to third parties such as prospective business partners and financial institutions. In any of these circumstances, only non-identifiable information and not personal information is disclosed.

5. CONFIDENTIALITY OF PERSONAL INFOMRATION

VHL will protect the confidentiality of personal information within the terms of this Statement. Personal information is stored in confidential databases and locations in the Greater Toronto Area. These sites have appropriate security measures in place to protect against the loss, misuse and alteration of personal information under the care and control of VHL. Any information transmitted via the internet, however, may be intercepted by third parties and, accordingly, VHL does not assume any liability for interception, alteration or misuse of information transmitted over the internet. VHL employees are restricted from using and disclosing personal information collected by VHL other than in accordance with this Statement.

6. REVISIONS TO PERSONAL INFORMATION

Personal information must be accurate, complete and up to date for the purposes for which it is collected. Accordingly, VHL will require individuals to amend inaccuracies and make corrections in their personal information collected by VHL from time to time as is necessary. 7. PERSONAL CHOICE

Individuals always have the choice as to whether or not they wish to supply personal information. However, individuals should be aware of the following in connection with a decision not to supply personal information:

(i) The execution and completion of Agreements of Purchase and Sale and related documentation will be contingent upon the provision of personal information required by VHL and VHL retains the right to refuse to enter into Agreements of Purchase and Sale and related documentation with those individuals refusing to provide the requisite personal information.

(ii) The decision to withhold personal information or to object to the use and/or disclosure of personal information as provided in this Statement or in any agreement between such individuals and VHL, may, in certain instances, limit their ability to complete purchases of VHL products and services.

Personal information is obtained and used only with the consent of the individual providing such information that may be expressed or implied depending on the circumstance.
